PAY UP IMPORTANT UPDATE
Following our 2023 pay ballet results in the summer, UNISON’s NJC Committee made the decision not to pursue industrial action. UNISON met with the other local government unions, GMB and Unite, on Wednesday 1 November, and the joint decision is to accept the pay offer for 2023 of an increase of £1,925 on all NJC pay points {pro rata’d for part-time and term time only staff). The pay award will be backdated to 1 April 2023.
We want to thank you for your patience while we have worked to resolve this year's pay dispute. The local government employers have been informed and our immediate priority is to get the money into the pay packets of our hardworking members as soon as possible. If you have any questions, please contact your local branch.
The NJC Committee will be meeting in November, and we are starting preparations for the 2024 pay campaign as a matter of urgency, starting with consulting on and submitting a joint pay claim. The fight to restore local government pay will continue and we plan to be stronger than ever to get fair pay for councils and school workers.

NJC STRIKE BALLOT
UNISON has been campaigning for a decent pay rise for council and school workers, who receive little recognition for their hard work.
Over the past 12 years, council and school staff have lost on average 25% from the value of their pay when measured against the Retail Price Index (RPI).
UNISON has called for a pay increase of inflation plus 2%, but employers are only offering a flat-rate increase. In a cost-of-living crisis, it's not good enough.

MENTAL HEALTH AWARENESS WEEK
Anxiety is a normal emotion in us all, but sometimes it can get out of control and become a mental health problem.
Lots of things can lead to feelings of anxiety, including exam pressures, relationships, starting a new job (or losing one) or other big life events. We can also get anxious when it comes to things to do with money and not being able to meet our basic needs, like heating our home or buying food. But anxiety can be made easier to manage.
Focusing on anxiety for this year's Mental Health Awareness Week will increase people's awareness and understanding of anxiety by providing information on the things that can help prevent it from becoming a problem. At the same time, we will keep up the pressure to demand change - making sure that improving mental health is a key priority for the government and society as a whole.

UNISON Welfare’s Energy Support Fund is open at 10am on Wednesday 16 November to help eligible members with rising fuel costs.

COST OF LIVING SURVIVAL
You are invited to join us for an important online event on 20th October aimed at providing you with the information you need to survive in these challenging times.
2022 NJC PAY OFFER VOTE
Dear members,
Over the last few weeks, you should have been contacted by your UNISON branch to ask if you wanted to vote to accept or reject the 2022 NJC pay offer of a £1,925 pay rise for council and school workers in England, Wales and Northern Ireland.
The consultation closed on Tuesday 20 September and we have now received the results. UNISON members have voted to accept the pay offer. Of those who voted, 63.5% voted to accept the offer and 36.5% voted to reject.
The key features of the pay offer are:
• With effect from 1 April 2022, an increase of £1,925 on all NJC pay points
• With effect from 1 April 2022, an increase of 4.04% on relevant allowances
• With effect from 1 April 2023, an increase of one day to all employees’ annual leave entitlement
• With effect from 1 April 2023, the deletion of pay point 1 from the NJC pay spine

What happens next?
We want your pay rise to get to you as quickly as possible.
There are three recognised unions involved in the local government pay talks: UNISON, GMB and Unite. We now await the results of GMB’s and Unite’s consultations on 2022 pay, both of which will end in October.
Once all three unions have their consultation results, we will meet to agree a joint trade union position.
If implemented, the pay award will be backdated to 1 April 2022.

UNISON - SUPPORTED LEGAL VICTORY SECURES NEW HOLIDAY RIGHTS FOR ALL WORKERS
All workers in the UK will now receive the same minimum level of paid annual holiday leave, regardless of how many hours they work, following a landmark legal judgment by the Supreme Court.
The case, Harpur Trust v Brazel & UNISON, was taken by music teacher Lesley Brazel. She argued her employer was wrong to give her fewer days of annual leave than the legal minimum because she only worked during the school term.
UNISON got involved in the Brazel case because of its implications for thousands of school staff employed on term-time only contracts. The situation had previously been confused because of the absence of any government guidance on their holiday rights, says UNISON.
Thanks to the judgment, it will no longer be possible for employers to argue staff who don’t work all year are only entitled to holiday based on the hours they work. Today’s decision is also good news for anyone working irregular hours or on zero-hours contracts, says the union.
From now on, all workers will be due the same legal minimum of 5.6 weeks (28 days for full-time employees), even if there are months during the year when they don’t work. The Supreme Court judgment upholds a previous decision taken by the Court of Appeal in 2019.
Commenting on the judgment, UNISON general secretary Christina McAnea said: “This important decision means that anyone, no matter when or how they work, will now be due the same legal minimum of annual holiday.
“Teaching assistants or other education employees might only be contracted to work when schools are open, but they’re also sometimes required to do their jobs at other times.
“Today’s decision clarifies the law and says that annual leave taken by someone who works less than a full year can no longer be pro-rated to that of a colleague employed all year round.
“The government’s failure to provide guidance in this area has left workers in limbo with unscrupulous employers all too keen to take advantage. Once again this shows unions as a force for good and yet another example of how they strive to improve the lives of working people everywhere.”
Notes for members
- The Supreme Court judgment ensures leave must be paid at the rate of an ordinary week’s wages (or if pay varies every week, then an average of all the weeks worked in a year). Annual leave calculations are based on weeks, as a person can work a full week or part of one. The law says that someone working a full year is entitled to at least 5.6 weeks of annual leave (28 days for anyone working full-time hours in a week and this can include the eight bank holidays). The judgment means that an employee working all year, but say, for just two days a week is entitled to 11.2 days a year (2 x 5.6 weeks, so 2.24 weeks or 11.2 days).
- UNISON intervened in the case in 2018, ahead of a hearing at the Court of Appeal the following year. The case had previously been through an employment tribunal and employment appeal tribunal. The Harpur Trust applied to the Court of Appeal for permission to appeal. UNISON successfully led the arguments at the Court of Appeal that all workers are entitled to a minimum of 5.6 weeks of annual leave under statute, and this should be paid at the rate of an ordinary week’s pay. The Supreme Court has now upheld this decision and its judgment (can be found below)
- UNISON is the UK’s largest union with more than 1.3 million members providing public services in education, local government, the NHS, police service and energy. They are employed in the public, voluntary and private sectors.
What does this mean for me in Blaenau Gwent?
Your Unison Blaenau Gwent Branch has asked the council to send them the formulae used to determine term time only and part time staff holiday pay. If the local authority is not complying with the court ruling then Unison will work with the council to make sure members get their entitlement.

SUPPORT FOR CARE WORKERS
Unison Wales is calling for a reversal of the profit making private sector provision which makes up the majority of care.
Local authorities must be able to deliver a national care service, in a modern and imaginative way, with the public reassured of the quality of care, continuity of care and relationships with a carer, and that public money should go directly into public care.
Carers are telling us they need a pay rise that will allow them to absorb the increase to the cost of living.
Private firms should not profit from people’s vulnerability says UNISON.

DEMAND ACTION DEMONSTRATION
All public sector workers are being forced to deal with a toxic mix of a decade of cuts combined with low wages and sky high fuel and energy bills as the cost-of-living crisis deepens.
On Saturday June 18, the trade union movement will be taking to the streets of London to demand action and UNISON Cymru/Wales is providing three buses to get our members to this vital demonstration.

UPDATE FOR TEACHING ASSISTANTS AND SCHOOL BASED MEMBERS
Unison has recently met with the Education Minister to share some of the feedback received in terms of the pilot on the longer school day. There isn’t much that we can say on this at the current time as the research of the pilot hasn’t been finalised yet and no decisions have been made.
In terms of changes to the school year, most of the research shows that there’s little to no benefit to them changing the term dates. Along with the other Education unions we are saying that now is not the time to be exploring any such changes – the impact from Covid is still being felt and is likely to be for some time. There are also some major reforms currently going on in education – namely the new curriculum and the ALN transformation, which reinforces why now would not be a good time to consider making any changes. Unison has said that we are willing to engage on discussing options when the time is right. Unison is heavily involved in all of the discussions and meetings and we will engage and update members as we go along.
A webinar for all school staff and other interested parties is going to be hosted by TUC on either 7th or 14th or 15th June at 6.00pm to discuss reform of the school year and see what the general feeling is across the whole workforce. As soon as its been arranged further details will be sent to all members.
Unison Blaenau Gwent Branch will be visiting all of the schools in the Borough over the next couple of months to engage fully with our members.

Political leaders of all parties will be watching nervously to see how well their candidates do in this week’s local elections.
Results often show how happy or unhappy people are with their local politicians and the local services they’re getting.
But it’s also a big reflection on how satisfied voters are with national party leaders.

LOCAL COUNCIL ELECTIONS
In less than a week 16-year-olds will be voting for the first time in a local election in Wales.
Unison Wales has heard from first time voter Julia who told us public services are vital to her.
She said: "Voting is vital for me because without doing so, people may not see the change that they would like to see, in the government, and in their day-to-day lives.
"By voting everyone has a say in their future and positive change will be implemented."
"It is extremely important for me as it reminds me that as a community we have a say and in turn change will take place."

LOCAL COUNCIL ELECTIONS
The local council elections in May are a great opportunity for UNISON Cymru Wales to talk about why it’s so important to invest in public services and in public service workers.

MONTH OF RAMADAN
The holy Muslim month of Ramadan falls neatly across April this year. Fasting began on 2 April and Eid-al-Fitr, the celebration that marks the end of Ramadan, is expected to fall on 1 May.
During this important holy period for Muslims, UNISON reminds both workers and employers that it is within the Equality Act 2010 for all employers to ensure flexible working and provide reasonable adjustments for staff wishing to observe Ramadan, which includes fasting, prayers, charity and reflecting on the Quran.

WELSH LABOUR CONFERENCE
Our very own Dave Rees spoke at the Welsh Labour Conference over the weekend.
Dave spoke about the need to review the number of members at the Senedd and how too few of them fail to scrutinise the huge legislative programme effectively. He went on to state our need for a strong Senedd, one that continues to protect the people of Wales from the uncaring, self-serving Conservatives.
